촉법소년을 어떻게 보호할까?

촉법소년의 상한 연령을 14세 미만에서 ‘강력·중대·반복 범죄’에 한해 ‘13세 미만으로 하향’하는 방안이 여론의 힘을 얻고 있다.
<2025년에 촉법소년은 2.1만명이었다>
촉법소년은 형벌 법령에 저촉되는 행위를 한 만 10세 이상 14세 미만 소년을 말한다. 경찰에 검거된 촉법소년은 2025년 2만 1095명으로 2021년 1만 1677명보다 80.7% 늘었다. 4년간 살인과 강도 사건은 줄었지만 절도는 5733건에서 1만 110건(76.3%), 폭력은 2750건에서 5520건(100.7%), 성폭력은 398건에서 739건(85.7%) 증가했다. 절도·폭력·성폭력이 늘면서 기존 보호처분만으로 대응이 충분하지 않다는 문제제기가 연령 기준 하향으로 이어졌다.
촉법소년은 2024년 전체 범죄자 158만 3108명에 대비하면 1.3%에 불과하다. 대한민국 범죄의 대부분은 성인이 일으키면서 여론은 14세 미만의 범죄 대책에 몰입하고 있다.
<촉법소년은 대부분 절도와 폭력이다>
촉법소년은 경찰이 검거하면 전부 법원 소년부로 송치하기 때문에 수치가 많은 것처럼 착시 현상이 일어난다. 만 14~18세 범죄소년은 경찰·검찰 단계에서 훈방이나 불기소 등으로 자체 종결 가능해 법원으로 넘어가지 않는 경우가 많다는 점과 크게 비교된다.
촉법소년이 법원에 송치됐을 때 상황을 보면, 2025년 기준 법원의 심리불개시 또는 불처분 비율이 48.8%로 보호처분을 받는 경우(47.4%)보다 많았다. 경찰의 검거는 늘었지만, 법원에서 절반이 풀려나는 정도의 가벼운 비위행위였다는 것이다.
촉법소년 중 유난히 많은 폭력도 크고 작은 학교폭력 문제가 경찰로 넘어오는 일이 많아진 영향이 크다. 2025년에 보호처분을 받은 촉법소년의 범죄 유형 중에선 절도가 34.6%로 가장 많았고 이어 폭행 13.9%, 성폭력처벌법 위반 7.1%, 폭력행위처벌법 위반 6.9% 순으로 나타났다. 과거에는 학교폭력이 생기면 보호자들이 화해하는 경우가 많았는데, 요즘은 “법대로 하자”고 경찰에 신고해서 촉법소년이 늘어나기도 한다. 최근 늘어난 절도도 무인점포에서 물건값을 계산하지 않고 가져가는 일이 늘어났기 때문이다. 점포 곳곳에 “물건값을 계산하지 않고 나가면 절도죄로 처벌된다”는 경고문을 크게 붙이고, 계산하지 않는 물건을 소지하고 문을 나서면 큰 경보음이 울리도록 규제해야 한다.
<촉법소년은 ‘보호처분’을 받을 수 있다>
촉법소년은 형법에서 ‘형사미성년자’로 범죄를 저질러도 형사상 처벌하지 않는다. 형법 제9조는 “14세 되지 아니한 자의 행위는 벌하지 아니한다”고 명시하고 있다. 일부 국민은 이 조항을 ‘촉법소년이 절도・폭력・성범죄를 일으켜도 처벌받지 않는다’로 오해한다. 이는 ‘참교육’이란 드라마에서 거짓 정보를 제공한 탓도 크다. 촉법소년은 ‘형사처분’ 대신 소년법에 의해 ‘보호처분’을 받을 수 있다.
보호처분이란 법원 소년부 판사가 소년보호사건을 심리한 결과 소년의 환경개선을 위해 국가의 보호가 필요하다고 인정할 때 내리는 처분이다. 소년부 판사는 감호 위탁이나 수강명령(100시간 이내), 사회봉사명령(200시간 이내), 장·단기 보호관찰, 장·단기 소년원 송치(2년 이내) 등의 처분을 내릴 수 있다. 감호 위탁이란 보호자나 보호자 대리인에게 촉법소년을 감독하고 보호하도록 책임을 맡기는 것이다. 수강명령은 자유로운 생활을 허용하면서 일정 시간 보호관찰소나 전문기관에서 교육을 받도록 하는 제도다. 죄질이 나쁜 12세 이상 촉법소년은 최장 2년간 소년원에 송치되어 학교 교육과 직업훈련, 심리치료, 상담 등을 받으며 생활해야 한다.
보호처분은 형사처분과 달리 전과 등의 기록이 남지 않지만, 소년원 송치 등은 소년의 삶에 큰 오점이다. 피해자들은 보호자를 상대로 손해배상 청구 등의 민사상 책임을 요구할 수 있다. 촉법소년보다 어린 만 10세 미만의 경우에는 형사책임에서 완전히 제외돼 보호처분 대상도 되지 않는다.
<죄질이 나쁜 촉법소년은 소년원에 간다>
촉법소년이 저지른 범죄 가운데 절도, 폭행, 성폭력 비중이 커지고 있는 만큼 이를 적극적으로 관리해야 한다. 2021년부터 2025년까지 소년원에 입소한 촉법소년은 263명이었는데, 이 중 219명(83.3%)이 13세였고 44명(16.7%)은 12세였다.
이런 현황은 촉법소년 연령기준을 1세라도 낮춰야 한다는 주장에 힘을 실어준다. 특히 “촉법소년이라 괜찮다”며 집단 폭행을 서슴지 않거나, 절도 행각에 어린 청소년을 가담시키는 일이 버젓이 벌어지는 상황은 촉법 연령 하향 요구가 커지는 배경이 됐다. 현행 촉법소년의 상한 연령이 1953년 형법이 제정될 당시 만들어진 점을 고려하면, 시대 변화를 반영해 기준을 현실화할 필요가 있다는 목소리도 꾸준히 제기돼 왔다.
<촉법소년의 연령을 낮추자는 여론이 높다>
올해 2월 이재명 대통령이 촉법소년 연령 하향 이슈에 대해 국민 의견을 수렴하는 공론화 절차를 추진하라고 지시했다. 이에 성평등가족부는 전문가 협의체를 운영하고 시민 212명을 모집해 숙의토론회를 열었다.
시민참여단은 1차 사전조사를 하고, 숙의토론을 마친 후 2차 조사하였다. 사후조사 결과 ‘현행 유지’는 17%로 1차 조사보다 11.3% 포인트 늘고, ‘모든 범죄 일괄 하향’은 30.2%로 7% 포인트 줄었으며, ‘강력하거나 중대, 반복 범죄 하향’은 46.7%로 1% 포인트 늘어났다.
성평등가족부 장관은 국무회의에서 대통령에게 ‘강력·중대·반복 범죄’에 한해 촉법소년 연령 상한을 ‘13세 미만으로 1세 하향’을 검토한다는 의견을 보고했다. 이와 함께 소년 비행 예방과 사후관리를 위해 범정부 추진 체계로 소년비행예방정책위원회(가칭) 설치도 검토한다고 밝혔다. 인권단체들은 촉법소년의 연령 하향에 대해 유엔아동권리협약의 취지에 부합하지 않는다고 비판했다.
<촉법소년의 연령 기준은 나라마다 다르다>
‘형사책임 최저연령(촉법소년에 해당)’은 나라마다 10세부터 18세까지 다양하다. 영국은 10세로 유럽 국가 중 가장 낮고, 네덜란드, 캐나다는 12세이다. 독일과 일본은 14세로 한국과 같다. 덴마크는 2010년에 15세에서 14세로 낮췄지만 효과에 대한 논란이 이어졌고 2012년에 다시 15세로 상향했다. 중국은 원칙은 16세지만 살인·중상해 등 중대한 범죄에 대해서는 최고인민검찰원의 승인 등을 거쳐 12~13세도 형사책임을 지도록 예외를 두고 있다. 한국은 12세 이상 14세 미만에서 2008년 6월 22일부터 10세 이상 14세 미만으로 바뀌었다.
<범죄를 예방하고 효과적으로 보호해야 한다>
촉법소년의 연령을 13세 미만으로 낮추더라도 죄를 짓는 소년은 줄지 않는다. 전문가들은 소년범은 대부분 형사처벌이 아니라 소년보호처분을 받기 때문에 시설·인력 등 보호처분 인프라를 개선해야 한다고 주장한다. 촉법소년을 전원 소년부로 송치하는 제도를 개선하여 훈방 등을 늘려야 한다. 가족기능 회복을 위한 가족치료명령의 신설, 치료가 가능하도록 소년의료보호시설 위탁의 개선, 소년원 기간 다양화 등을 구현해야 한다. 촉법소년의 연령을 낮춘다고 문제가 해결되지 않기에 보호처분의 효과성을 높이는데 집중해야 한다.

How should juvenile offenders be protected?

A proposal to lower the upper age limit for juvenile offenders from under 14 to under 13, but only for “serious, grave, and repeated offenses,” is gaining public support.
A juvenile offender refers to a boy aged 10 or older but under 14 years of age who has committed an act that violates penal law. The number of juvenile offenders arrested by the police reached 21,095 in 2025, an 80.7% increase from 11,677 in 2021. While murders and robbery decreased over the four years, theft rose from 5,733 to 10,110 (76.3%), violence from 2,750 to 5,520 (100.7%), and sexual violence from 398 to 739 (85.7%). As theft, violence, and sexual violence increased, concerns were raised that existing protective measures alone were insufficient, leading to a downward revision of the age threshold.
Compared to the total 1,583,108 offenders in 2024, juvenile offenders account for only 1.3%. Most crimes in South Korea are committed by adults, while public opinion is focused on measures against crimes committed by those under 14.
Because all juvenile offenders are referred to the juvenile division of the court once the police apprehend them, an illusion occurs that they are many in number. This is in stark contrast to the fact that juvenile offenders aged 14 to 18 are often able to be closed internally at the police or prosecution stage through leniency or non-prosecution, and thus are not referred to the court.
Looking at the situation when juvenile offenders were referred to the court, as of 2025, the rate of courts deciding not to open a hearing or not to issue a disposition was 48.8%, higher than the 47.4% rate when protective measures were granted. Although police arrests increased, these were only minor acts of misconduct—enough to result in half of them being released by the courts.
A major factor is that, among juvenile offenders, the unusually high number of school violence cases, both large and small, have increasingly been referred to the police. Among the types of crimes committed by juvenile offenders who received protective custody in 2025, theft was the most common at 34.6%, followed by assault at 13.9%, violations of the Sexual Violence Punishment Act at 7.1%, and violations of the Act on the Punishment of Violent Acts at 6.9%. In the past, when school violence occurred, parents often made up with the other party, but nowadays, they report it to the police saying, “Let’s do it according to the law,” and the number of juvenile offenders under the age of criminal responsibility is increasing. This is because theft has increased recently, with more people taking items from unmanned stores without paying for them. Large warning signs saying, “If you leave without paying for the items, you will be punished for theft,” should be posted throughout the store, and regulations should be enforced so that carrying items that are not being paid for and leaving the premises triggers a loud alarm.
In criminal law, a juvenile offender, or a “criminal under the law,” is not subject to criminal punishment even if they commit a crime. Article 9 of the Criminal Act states, “The acts of a person not yet 14 years old shall not be punished.” Some citizens misunderstand this provision as meaning that “a juvenile offender is not punished even if they commit theft, violence, or sexual crimes.” A large part of this is also due to providing false information in the drama "True Education." A juvenile offender may receive a protective disposition under the Juvenile Act instead of a criminal punishment.
A protective disposition is a decision made by a juvenile court judge after reviewing a juvenile protection case, when it is recognized that the state’s protection is necessary for the improvement of the juvenile’s environment. A juvenile court judge may issue measures such as placement under guardianship, a course of instruction (up to 100 hours), a community service order (up to 200 hours), short- or long-term probation, or transfer to a juvenile detention center for a short- or long-term period (up to 2 years). Guard supervision delegation means entrusting a guardian or a guardian’s representative with the responsibility of supervising and protecting a juvenile offender. The course instruction order is a system that allows a free lifestyle while requiring individuals to receive education for a certain period at a probation office or a specialized institution. Juvenile offenders aged 12 and older with particularly serious offenses shall be sent to a juvenile detention center for up to two years and live there while receiving schooling, vocational training, psychotherapy, counseling, and other support.
Unlike criminal punishment, protective measures do not leave records such as criminal history, but sending a juvenile to a juvenile detention center, among other things, leaves a deep stain on the juvenile’s life. Victims may demand civil liability, such as a claim for damages, against the guardian. Persons under the age of 10, who are younger than a juvenile offender, are completely excluded from criminal liability and are not subject to protective measures.
As the proportion of crimes committed by juvenile offenders—including theft, assault, and sexual violence—is increasing, they must be actively managed. From 2021 to 2025, 263 juvenile offenders were admitted to juvenile detention centers, of whom 219 (83.3%) were 13 years old and 44 (16.7%) were 12 years old.
This situation lends weight to the argument that the age threshold for juvenile offenders should be lowered by even one year. In particular, situations where people openly engage in group assaults, saying things like “he’s a juvenile offender, so it’s fine,” or involve young teenagers in theft, have fueled growing calls to lower the age of criminal responsibility. Considering that the current upper age limit for juvenile offenders was established when the Criminal Act was enacted in 1953, there have also been consistent calls to update the standard to reflect changing times.
There is growing public opinion to lower the age of juvenile offenders
In February of this year, President Lee Jae-myung instructed that a public deliberation process be promoted to gather public opinion on the issue of lowering the age of criminal responsibility for juvenile offenders. In response, the Ministry of Gender Equality and Family operated an expert advisory group and held a deliberation forum by recruiting 212 citizens.
The citizen participation group conducted a first preliminary survey, followed by a second survey after completing deliberative discussions. The post-implementation survey showed that 17% favored maintaining the status quo, an increase of 11.3 percentage points from the first survey, while 30.2% favored lowering all crimes collectively, a decrease of 7 percentage points; and 46.7% favored lowering violent, serious, or repeat offenses, an increase of 1 percentage point.
At a Cabinet meeting, the Minister of Gender Equality and Family reported to the President that, for “serious, grave, and repeated crimes,” they are considering lowering the upper age limit for juvenile offenders by one year to under 13. In addition, he said that the establishment of a provisional “Juvenile Delinquency Prevention Policy Committee” under a government-wide promotion system for the prevention and follow-up management of juvenile delinquency is also being considered. Human rights organizations criticized the lowering of the age of criminal responsibility for juvenile offenders as not aligning with the spirit of the UN Convention on the Rights of the Child.
The minimum age for criminal responsibility (classified as a juvenile offender) varies by country, ranging from 10 to 18 years old. In the United Kingdom, it is 10 years old, the youngest among European countries, while the Netherlands and Canada are 12 years old. Germany and Japan are 14 years old, the same as Korea. Denmark lowered the age limit from 15 to 14 in 2010, but controversy over its effectiveness continued, and it raised it again to 15 in 2012. In China, the age of responsibility is generally 16, but for serious crimes such as murder and serious injury, there is an exception allowing even 12- or 13-year-olds to bear criminal responsibility after approval from the Supreme People’s Procuratorate. In Korea, the age limit changed from 12 to under 14 years old on June 22, 2008, to 10 to under 14 years old.
We must prevent crime and protect effectively
Even if the age of a juvenile offender is lowered to under 13, the number of boys committing crimes will not decrease. Experts argue that because juvenile offenders mostly receive juvenile protection measures rather than criminal punishment, the infrastructure for protective measures—such as facilities and personnel—must be improved. The system of transferring juvenile offenders to the Juvenile Division in all cases should be improved to increase leniency and other measures. We must establish family therapy orders to restore family functioning, improve the delegation of juvenile medical protection facilities so that treatment is possible, and diversify the duration of juvenile detention centers. Lowering the age of juvenile offenders does not solve the problem, so the focus should be on enhancing the effectiveness of protective measures.
